General Terms and Conditions (GTC)
1. Scope of Application
These General Terms and Conditions (GTC) apply to all orders and purchases made by customers via the online shop shop.fidgetandshine.ch or at a physical point of sale (POS) operated by Fidget & Shine, a company of Hitz & more (CHE-243.305.791), Wohlenschwilerweg 11, 5507 Mellingen (hereinafter referred to as "Provider").
2. Conclusion of Contract
The contract is concluded when the customer completes the order and the Provider accepts the order by sending a confirmation email. The Provider reserves the right to refuse orders without giving reasons. At the POS, the GTC apply as soon as the goods are taken into possession; this constitutes a contract conclusion.
3. Prices
All prices listed in the online shop and locally are in Swiss francs (CHF). Shipping costs are calculated separately and shown separately.
4. Payment Terms
The customer has the following payment options: credit card, PayPal, invoice, or other payment methods offered in the online shop. For payments by invoice, the payment term is 10 days from the invoice date. In case of late payment, default interest of 5% per annum may be charged. If an outstanding invoice is not paid within the granted payment term, a fee of CHF 20 will be charged for the first reminder, and a fee of CHF 30 will be charged for the second reminder. Any additional collection costs will be borne entirely by the debtor.
5. Delivery
Delivery will be made to the delivery address provided by the customer. The stated delivery times are non-binding unless expressly confirmed in writing as binding. The supplier is not liable for delivery delays caused by third parties.
6. Retention of Title
The delivered goods remain the property of the supplier until full payment has been received.
7. Theft
In the event of theft, in addition to the value of the stolen goods, the following flat fees per incident will be charged as expenses:
CHF 100 for thefts up to CHF 10
CHF 150 for thefts exceeding CHF 10
An incident corresponds to a single act: the theft of goods at a specific time without proper payment. Should goods be stolen repeatedly, a flat fee will be charged for each individual incident, and a ban from the premises will be issued.
In addition to pursuing civil claims, we reserve the right to file a criminal complaint for theft (Art. 139 of the Swiss Criminal Code).
8. Warranty and Liability
The customer must inspect the delivered goods for defects immediately upon receipt and notify us of any defects in writing within 7 days. In the case of proven defects, a replacement delivery or credit note will be issued. The supplier's liability is limited to intent and gross negligence. Liability for consequential damages is excluded.
9. Data Protection
Personal data will be treated confidentially and used only for processing the order and for legal purposes. Further details can be found in the supplier's privacy policy.
10. Changes to the Terms and Conditions
The supplier reserves the right to amend these Terms and Conditions at any time. Changes will be communicated in a timely manner and are considered accepted unless the customer objects within 30 days.
11. Applicable Law and Jurisdiction
These Terms and Conditions are governed by Swiss law. The exclusive place of jurisdiction is Baden, Switzerland.
12. Final Provisions
Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected. Invalid or missing provisions shall be replaced by provisions that most closely approximate the economic purpose of the original provision.
